These terms set out the conditions for using Proofie (the "App"), an iOS app provided by OurBeom (아워범) (the "Company"). They cover the iOS app (App Store ID 6809110642, bundle ID com.ourbeom.proofie).

How the App handles personal data is set out separately in the Privacy Policy.

Article 1 (Purpose)

These terms set out the rights, obligations and responsibilities of the Company and of users in connection with the use of the App.

Article 2 (Effect and amendment of these terms)

These terms take effect when posted inside the App.

The Company may amend these terms to the extent that doing so does not violate applicable law. When it does, it announces the changes and the effective date inside the App, and changes unfavourable to users are announced at least 30 days before they take effect.

A user who does not agree to the amended terms may stop using the App and delete it, or cancel the subscription, before the effective date. Continuing to use the App after that date is taken as agreement — except that, for an unfavourable change, a user who states an objection is not taken to have agreed, and the Company will explain how to cancel the subscription.

Article 3 (What the service provides)

The App provides the following.

  • Taking a photo, or importing one from the photo library
  • Laying the date, time, day of the week and similar fields over a photo as a template to produce an image
  • Saving the resulting image to the device, or sharing it with other apps
  • Collecting the records you have made in one place on the device

Of these, saving and sharing with some templates, and removing the watermark, are available only to subscribers. Preview and editing are available without a subscription, without restriction.

Article 4 (Use without an account)

The App can be used without signing up.

Photos and records you create are stored only on your device, and the Company does not keep them. If you lose your device or delete the App, the Company cannot restore them. Please keep important records separately, for example in the Photos app.

Article 5 (Paid subscription)

  • The price, period and renewal conditions of the subscription are those shown on the purchase screen, and payment is taken only after you have seen and agreed to them.
  • The subscription renews automatically. Unless it is cancelled at least 24 hours before the current period ends, it renews on the same terms, and the renewal fee is charged within the 24 hours before the period ends.
  • You can cancel at any time in your device's App Store account settings. After cancelling you keep access until the end of the period you have already paid for, and it does not renew after that.
  • If the Company raises the price, it announces the change and when it applies at least 30 days in advance, and applies it to existing subscribers only with their consent.

Article 6 (Withdrawal of purchase and refunds)

  • Under Article 17 of the Act on Consumer Protection in Electronic Commerce, you may withdraw your purchase within 7 days of payment.
  • However, under Article 17(2)5 of the same Act, withdrawal is restricted for a paid feature once you have used it. Using a paid feature here means saving or sharing an image made with a paid template, or exporting with the watermark removed. If you have paid but not yet done either, you may withdraw within the period.
  • If the Company has not clearly shown this restriction where you could easily see it, or has provided something different from what the App displayed, or the App cannot be used because of a defect, you may withdraw regardless of the restriction above.
  • Payment and refunds are processed by Apple's App Store. Requests to withdraw or refund can be made through the App Store's refund process, and if you write to contact@ourbeom.com the Company will explain the process and give whatever help is needed. The Company does not refuse a withdrawal or refund that the law grants you on the ground of Apple's policy.
  • This article does not limit any right the law guarantees you.

Article 7 (Payment by minors)

A payment made by a user under 19 without the consent of a legal representative may be cancelled by the user or by that representative. If you wish to cancel, write to contact@ourbeom.com and we will explain the App Store refund process.

Article 8 (Rights in content)

Rights in the photos you take or import, and in the images you create with the App, belong to you. The Company claims no rights in them and neither collects nor uses them.

Rights in the template designs, typefaces, logos and screen layouts provided by the App belong to the Company or to the respective rights holders. You may use them only as part of using the App, and may not extract, copy or redistribute the templates themselves.

Article 9 (User obligations)

Users must not do the following.

  • Use another person's photo or likeness without the rights holder's consent
  • Reverse-engineer the App, or copy, distribute or modify it without authorisation
  • Interfere with the normal operation of the App
  • Create and distribute images that violate the law or infringe the rights of others

Article 10 (Changes to or suspension of the service)

The Company may change the content of the service or discontinue it. Changes affecting a paid subscription, and termination of the service, are announced inside the App at least 30 days in advance, and users with a paid period remaining are refunded the amount corresponding to the remaining period.

The service may be interrupted temporarily for unavoidable reasons such as a natural disaster, equipment failure or a change in store policy, and in such cases advance notice may not be possible.

Article 11 (Liability)

The Company compensates, as provided by applicable law, for damage caused to users by reasons attributable to the Company in connection with these terms.

The Company is not liable in the following cases.

  • Loss of photos or records stored on your device — the Company does not keep them, so it has no way to restore or preserve them.
  • The content of images you create with the App, and problems arising from your publishing those images elsewhere.
  • Inability to provide the service due to force majeure such as a natural disaster.

Article 12 (Resolution of disputes)

Where a dispute arises between the Company and a user, the two will consult in good faith to resolve it.

If consultation does not succeed, a user may apply for mediation under the Act on Consumer Protection in Electronic Commerce and the Framework Act on Consumers, to the Korea Consumer Agency counselling centre (1372, ccm.go.kr) or the Electronic Commerce Mediation Committee (ecmc.or.kr).

Article 13 (Governing law and jurisdiction)

These terms are interpreted under the laws of the Republic of Korea.

Where litigation is necessary it is brought before the court having jurisdiction under the Civil Procedure Act; where the user is a consumer, the court for the user's address (or place of residence if there is no address) at the time of filing also has jurisdiction.

Article 14 (Contact)

For questions about the App, use [Settings → Contact] inside the App or write to contact@ourbeom.com.
